■ 8월 13일 국회에서 시작된 논란
논란의 출발점은 지난 8월 13일 국회도서관 대강당에서 열린 ‘5·18 민주화운동의 재조명 국회공개포럼’이다.
이진숙 의원이 시민단체 새역사국민운동과 개최한 이 행사에서는 이영훈 새역사국민운동 공동대표를 비롯해 김용삼 이승만학당 교수, 주동식 호남대안포럼 공동대표 등이 참여했다.
포럼에서는 5·18을 ‘소요 사태’라고 표현하는 등 기존의 5·18 역사적 평가와 충돌하는 발언들이 나왔다. 행사 도중 청중들의 거센 항의가 이어졌고 참석자 사이에 물병을 던지거나 멱살을 잡는 충돌까지 발생해 경찰이 출동했다.
더 주목되는 것은 행사 개최 전부터 국민의힘 내부에서 논란을 우려했다는 점이다.
연합뉴스 보도에 따르면 이 의원이 참석자 명단을 공개한 이후 복수의 의원들이 불필요한 논란을 우려해 행사 취소를 요청했다. 국민의힘 원내지도부도 사전에 취소를 권고했다고 밝혔으며 행사에서 나온 내용은 당의 공식 입장이 아니라고 선을 그었다.
그러나 이 의원은 행사를 진행했다.
현장에서 항의로 행사가 여러 차례 중단되자 이 의원은 소란으로 행사를 중단시키는 것이 특정 세력의 목표라는 취지로 말하며 회의를 속개했다. 또 “5·18은 특정 진영의 소유물이 돼선 안 된다”며 불편한 질문이 있더라도 학술적으로 접근할 길이 열려 있어야 한다는 취지로 행사 개최 이유를 설명했다.

■ 9월 10일에는 실제 ‘북한군 개입설’ 등장
논란은 여기에서 끝나지 않았다.
MBC 보도에 따르면 지난 9월 10일 국회 본청 앞에서 이진숙 의원 주최로 열린 행사에서 트루스코리아 정부영 대표가 5·18 북한군 개입 문제를 직접 거론했다.
정부영 대표는 “5·18도 북한군 개입이 절대 없다고 합니다. 이것도 사실일까요, 거짓일까요”라고 청중에게 물었고, 청중에서는 “거짓입니다”라는 답변이 나왔다. 정부영 대표는 이어 이 문제를 학술대회를 통해 밝혀야 한다는 취지로 말했다.
또 다른 참가자도 5·18 당시 ‘불순세력’이 있었던 것 아니냐는 취지의 확인되지 않은 주장을 제기했다. 같은 행사에서는 부정선거론도 등장했다.
이 의원은 이날 자신의 5·18 토론회 개최를 옹호하면서 5·18 유공자 전체 명단 공개를 요구했다.
따라서 현재 확인되는 사실을 기준으로 하면 이진숙 의원 본인이 북한군 개입설을 직접 주장했다고 단정할 근거와, 이진숙 의원이 주최한 행사에서 다른 참가자가 북한군 개입설을 공개적으로 제기했다는 사실은 엄격하게 구분할 필요가 있다.

■ 민주당 고발장에는 ‘방조’가 들어갔다
이 구분은 이번 경찰 수사의 핵심이기도 하다.
더불어민주당 법률위원회와 전남광주통합특별시 지역 국회의원들은 지난 15일 이진숙 의원과 이영훈 새역사국민운동 공동대표, 김용삼 교수, 주동식 공동대표 등 4명을 ‘5·18민주화운동 등에 관한 특별법’ 위반 혐의로 서울경찰청에 고발했다.
특히 민주당 측이 공개한 고발 취지를 보면 이 의원이 직접 모든 문제 발언을 했다는 주장에만 의존하고 있지 않다.
민주당은 이 의원이 8월 13일 국회 공개포럼을 주최해 다른 피고발인들이 5·18에 관한 허위사실을 유포하도록 ‘방조했다’고 주장했다.
여기에 이 의원이 자신의 공식 유튜브 채널 ‘위풍당당 이진숙’에 포럼 관련 동영상을 게시함으로써 문제의 내용이 유포·확산됐다는 주장도 고발 내용에 포함됐다.
민주당은 9월 10일 이 의원이 주도한 국회 행사에서 북한군 개입설이 제기된 점도 문제 삼았다.
결국 수사 대상은 ‘이진숙 의원이 북한군 개입설이라는 문장을 직접 말했는가’에만 한정되지 않을 가능성이 있다.
이진숙 “북한군 소행이라고 말한 적 없다”
반면 이 의원의 입장은 분명하다.
이 의원은 자신을 “5·18 북한군 소행이라 하는 사람”이라고 SNS에 표현한 민주당 박지원 의원을 지난 15일 정보통신망법상 명예훼손 혐의로 서울 영등포경찰서에 고소했다.
박 의원은 지난 13일 자신의 블로그와 페이스북에 이 의원을 지칭해 “5·18 북한군 소행이라 하는 사람”이라는 취지의 글을 게시했다.
이에 이 의원은 자신이 5·18민주화운동을 북한군 소행이라고 주장하거나 북한군 개입설에 동조하는 발언을 한 사실이 없다며 법적 책임을 묻겠다고 밝혔다.
또 지난 8월 13일 국회 토론회 역시 5·18을 민주화운동으로 규정한다는 전제 아래 개최했다고 설명했다.
따라서 현재 공개자료만으로 “이진숙 의원이 북한군 개입설을 직접 주장했다”고 사실로 단정하는 것은 적절하지 않다.

■ 그렇다면 ‘침묵=동의’로 볼 수 있나
여기에서 정치적·사회적 평가와 형사법적 판단을 구분해야 한다.
사회적으로는 행사 주최자가 특정 주장을 하는 발표자에게 발언 기회를 제공하고, 문제 발언을 들은 뒤에도 이를 반박하지 않은 채 행사를 계속 진행했다면 이를 ‘묵시적 동의’, ‘용인’, ‘공론화에 대한 동조’로 볼 수 있다는 비판이 제기될 수 있다.
그러나 그것이 곧바로 법률상 “발표자의 주장을 주최자의 주장으로 간주한다.”는 결론으로 이어지는 것은 아니다.
특히 이번 사건에서는 단순히 같은 장소에 있었다는 것보다 더 구체적인 사실관계가 중요하다.
경찰 수사에서는 발표자를 누가 선정했는지, 발표 내용이나 자료를 이 의원 측이 사전에 확인했는지, 북한군 개입 관련 주장이 나올 가능성을 알고 있었는지, 현장에서 해당 발언이 나왔을 때 어떤 조치를 했는지, 행사 이후 관련 영상을 왜 공식 유튜브에 게시했는지 등이 확인될 필요가 있다.
이런 사실관계가 밝혀져야 ‘묵시적 동의’라는 정치적 평가를 넘어 실제 특별법 위반에 대한 방조 등의 법적 책임이 성립하는지 판단할 수 있다.

■ ‘한 번의 우발적 발언인가, 반복된 행사인가’도 쟁점
이번 사건에서 주목할 또 하나의 부분은 시간의 연속성이다.
8월 13일에는 당 지도부의 취소 요청에도 이 의원이 국회도서관에서 5·18 재조명 포럼을 개최했고, 논란성 발언과 충돌이 발생한 뒤에도 행사를 계속했다.
그리고 약 한 달 뒤인 9월 10일 이 의원이 주최한 또 다른 국회 행사에서 참가자가 북한군 개입설을 공개적으로 제기했다.
민주당 역시 고발 과정에서 이 같은 일련의 행위를 함께 문제 삼고 있다.
따라서 경찰이 개별 발언만 떼어 볼 것인지, 행사 기획과 개최·진행 및 사후 영상 확산까지 하나의 과정으로 볼 것인지도 향후 주목할 대목이다.
박지원 고소 사건도 결국 ‘직접 주장’과 ‘동조·용인’ 구분이 핵심
반대 방향으로 진행되는 박지원 의원 명예훼손 사건에서도 이 차이는 중요하다.
박 의원이 이 의원을 “5·18 북한군 소행이라 하는 사람”이라고 표현한 것은 문자 그대로 읽으면 이 의원 본인이 북한군 소행설을 직접 주장했다는 의미로 받아들여질 여지가 있다.
이 의원은 바로 이 부분이 허위라고 주장하고 있다.
반면 공개적으로 확인된 것은 이 의원 자신이 북한군 개입설을 직접 말했다는 사실이 아니라, 이 의원이 주최한 9월 10일 국회 행사에서 참가자가 북한군 개입설을 제기했다는 사실이다.
때문에 두 사실을 혼동해서는 안 된다.
동시에 이 의원이 행사 주최자로서 어떤 내용을 사전에 알고 있었는지, 현장에서 문제 발언을 어떻게 받아들였는지 역시 별도의 사실관계로 규명할 필요가 있다.

■ “나는 말하지 않았다”만으로 끝날 문제인가
이번 사건에서 결국 경찰이 확인해야 할 것은 ‘발언의 주체’와 ‘행사의 책임’이다.
이진숙 의원이 북한군 개입설을 직접 주장했는지 여부와, 자신이 주최한 행사에서 그러한 주장이 제기되는 것을 알고도 허용·확산했는지 여부는 서로 다른 문제다.
현재까지 확인된 자료만으로는 “이진숙 의원이 북한군 개입설에 동의했다”는 것을 확정된 사실로 보도할 수 없다. 침묵이나 행사 진행만으로 개인의 내심까지 단정할 수도 없다.
그러나 8월과 9월 국회에서 이어진 행사 개최 과정, 당 지도부의 사전 취소 요청, 발표자와 참가자 선정 과정, 현장에서의 대응, 공식 유튜브 영상 게시 여부 등은 이 의원이 단순히 우연히 문제 발언을 들은 제3자였는지, 아니면 해당 주장들이 제기될 수 있는 장을 의도적으로 마련하고 유지했는지를 판단하는 데 중요한 사실관계가 될 수 있다. 민주당의 고발 역시 ‘직접 발언’뿐 아니라 방조와 영상 확산을 문제 삼고 있다.

따라서 이번 사건은 “북한군 개입설을 직접 말했느냐, 안 했느냐”만으로 결론낼 사안이 아니다.

수사기관이 행사 기획자료와 발표문, 발표자 섭외 과정, 사전 협의 내용, 현장 전체 영상, 이 의원의 당시 발언과 대응, 공식 유튜브 게시 과정 등을 확인한다면 직접 발언과 별개로 주최자로서 어디까지 알고 있었고 어떤 행위를 했는지가 보다 구체적으로 드러날 수 있다.

다만 고발은 혐의 제기 단계이며 이 의원과 다른 피고발인들의 5·18특별법 위반 여부, 박지원 의원의 명예훼손 혐의 역시 현재 확정된 것은 없다. 최종적인 형사책임은 수사와 사법절차를 통해 판단돼야 한다.

The controversy surrounding People Power Party lawmaker Lee Jin-sook over the May 18 Democratic Uprising has developed into criminal cases.
The issues are not straightforward. The question is not limited to whether Lee herself explicitly said, “May 18 was carried out by North Korea.” Investigators may also examine whether she continued events she hosted or led despite other participants making controversial claims about May 18, whether she knew in advance that such claims would be made, and whether related videos were subsequently distributed through her official channels.
In particular, at a National Assembly event hosted by Lee on September 10, a participant publicly raised the theory of North Korean involvement in the May 18 Uprising, according to media reports.
As a result, apart from Lee’s statement that she had “never made remarks endorsing the North Korean involvement theory,” a separate issue has emerged over how she responded, as the organizer, when such claims were made at her event.
■ Controversy Began at National Assembly on August 13
The controversy began with the “National Assembly Public Forum for Reexamining the May 18 Democratic Uprising,” held at the National Assembly Library auditorium on August 13.
The event was organized by Rep. Lee Jin-sook together with the civic group New History National Movement. Participants included Lee Young-hoon, co-representative of the organization; Kim Yong-sam, a professor at the Syngman Rhee Academy; and Joo Dong-sik, co-representative of the Honam Alternative Forum.
During the forum, remarks were made that conflicted with established historical assessments of May 18, including references to the uprising as a “disturbance.”
Strong protests erupted from members of the audience, and physical confrontations reportedly occurred, including incidents involving thrown water bottles and people grabbing one another by the collar. Police were eventually called to the scene.
Of particular significance is the fact that concerns had reportedly been raised within the People Power Party even before the event took place.
According to Yonhap News Agency, after Lee disclosed the list of participants, several lawmakers urged her to cancel the event out of concern that it could trigger unnecessary controversy.
The People Power Party’s floor leadership also said it had advised Lee in advance to cancel the forum and later distanced the party from the remarks made there, saying they did not represent the party’s official position.
Lee nevertheless proceeded with the event.
When protests repeatedly interrupted the forum, Lee resumed the proceedings, saying in effect that disrupting the event was the objective of certain groups.
She also explained the purpose of the forum by saying that “May 18 should not belong to any particular political camp” and that there should be room for an academic approach even when uncomfortable questions are raised.
■ North Korean Involvement Theory Explicitly Raised on September 10
The controversy did not end there.
According to an MBC report, at another event hosted by Lee in front of the main National Assembly building on September 10, Jeong Boo-young, head of Truth Korea, directly raised the question of North Korean involvement in May 18.
Jeong asked the audience:
“They say there was absolutely no North Korean involvement in May 18. Is that true or false?”
Members of the audience responded, “False.”
Jeong then said, in substance, that the issue should be examined through an academic conference.
Another participant reportedly raised an unverified claim questioning whether “subversive elements” had been involved during the May 18 Uprising. Claims of election fraud were also raised during the same event.
On that day, Lee defended her decision to hold discussions on May 18 and called for the full disclosure of the names of May 18 recognized contributors.
Based on the facts publicly confirmed so far, therefore, two matters need to be clearly distinguished: whether Lee herself directly advocated the North Korean involvement theory, and the confirmed fact that a participant at an event hosted by Lee publicly raised such a theory.
■ Democratic Party Complaint Includes Allegation of ‘Aiding’ Dissemination
This distinction is also central to the police investigation.
On September 15, the Democratic Party’s Legal Affairs Committee and lawmakers from the Jeonnam-Gwangju Special Metropolitan City region filed a complaint with the Seoul Metropolitan Police Agency against four people — Rep. Lee Jin-sook, Lee Young-hoon, Kim Yong-sam and Joo Dong-sik — alleging violations of the Special Act on the May 18 Democratization Movement.
According to the Democratic Party’s publicly stated grounds for the complaint, its case does not rely solely on an allegation that Lee personally made every controversial statement.
The party alleges that by hosting the August 13 public forum at the National Assembly, Lee “aided” the other accused individuals in disseminating what the party describes as false information about May 18.
The complaint also reportedly raises the issue of Lee posting a video of the forum on her official YouTube channel, “Confident Lee Jin-sook,” allegedly contributing to the further dissemination of the disputed content.
The Democratic Party has also cited the fact that the North Korean involvement theory was raised at the September 10 National Assembly event led by Lee.
Accordingly, the scope of the investigation may not necessarily be confined to the question of whether Lee personally uttered the words alleging North Korean involvement.
■ Lee: “I Never Said May 18 Was Carried Out by North Korea”
Lee’s position, meanwhile, is clear.
On September 15, she filed a complaint with Seoul’s Yeongdeungpo Police Station against Democratic Party lawmaker Park Jie-won, alleging defamation under the Information and Communications Network Act.
Park had posted comments on his blog and Facebook account on September 13 describing Lee, in substance, as “a person who says May 18 was carried out by North Korea.”
Lee responded that she had never claimed that the May 18 Democratic Uprising was carried out by North Korea and had never made remarks endorsing the theory of North Korean involvement. She said she would seek legal accountability for Park’s statement.
Lee also said the August 13 National Assembly forum had been held on the premise that May 18 was a democratic uprising.
Therefore, based on currently available public information, it would not be appropriate to state as an established fact that “Rep. Lee Jin-sook personally advocated the North Korean involvement theory.”
■ Does Silence Amount to Agreement?
This is where political and social assessments must be distinguished from criminal-law conclusions.
From a social or political standpoint, critics may argue that if the organizer of an event provides speakers with a platform to make a particular claim, does not challenge the claim when it is made, and continues the event, such conduct could be interpreted as “tacit approval,” “tolerance,” or “support for bringing the claim into public discourse.”
However, that does not automatically mean, as a matter of law, that a speaker’s statement can be legally attributed to the organizer as the organizer’s own statement.
In this case, the details matter considerably more than the mere fact that Lee was present at the same event.
Police may need to determine who selected the speakers, whether Lee or her staff reviewed their presentations or materials in advance, whether they knew that claims concerning North Korean involvement might be raised, how Lee responded when such statements were made, and why related footage was subsequently uploaded to her official YouTube channel.
Only after these facts are established can investigators determine whether conduct politically characterized as “tacit approval” could also meet the legal requirements for aiding a violation of the May 18 Special Act.
■ Was It an Isolated Remark, or Part of a Repeated Pattern of Events?
Another issue attracting attention is the sequence of events over time.
On August 13, despite requests from the party leadership to cancel the event, Lee went ahead with the May 18 forum at the National Assembly Library and continued proceedings even after controversial remarks and clashes occurred.
Then, less than a month later, at another National Assembly event hosted by Lee on September 10, a participant publicly raised the North Korean involvement theory.
The Democratic Party has cited this sequence of events as part of its complaint.
Investigators may therefore examine whether each statement should be considered separately or whether the planning, hosting and continuation of the events, together with the subsequent distribution of related videos, are relevant as a broader course of conduct.
■ Park Jie-won Case Also Turns on Distinction Between ‘Direct Advocacy’ and ‘Approval or Tolerance’
The same distinction is important in the defamation complaint against Park Jie-won.
Park’s description of Lee as “a person who says May 18 was carried out by North Korea” could, read literally, be understood as asserting that Lee herself directly advocated the theory.
Lee maintains that this assertion is false.
What has been publicly confirmed, by contrast, is not that Lee herself directly articulated the North Korean involvement theory, but that a participant at the September 10 event hosted by Lee raised the theory publicly.
Those two facts should not be conflated.
At the same time, what Lee knew beforehand as the organizer and how she responded when the statements were made remain separate factual questions that may require further investigation.
■ Is “I Never Said It” Enough to Resolve the Issue?
Ultimately, investigators will need to distinguish between the person who made the statement and the responsibility associated with organizing and conducting the event.
Whether Lee personally advocated the North Korean involvement theory and whether she knowingly permitted or facilitated such claims at an event she hosted are different questions.
Based on the information confirmed so far, it cannot be reported as an established fact that “Lee Jin-sook agreed with the North Korean involvement theory.” Silence or continuation of an event alone cannot conclusively establish a person’s private beliefs.
However, the circumstances surrounding the August and September National Assembly events — including the party leadership’s prior request for cancellation, the selection of speakers and participants, Lee’s response at the scene, and the alleged posting of the forum video on her official YouTube channel — may be relevant in determining whether Lee was merely a third party who happened to hear controversial statements or whether she knowingly created and maintained a forum in which such claims could be presented.
The Democratic Party’s complaint similarly raises allegations not only concerning direct statements but also aiding and the subsequent dissemination of the content.
The controversy, therefore, cannot necessarily be resolved solely by asking whether Lee personally uttered the North Korean involvement claim.
If investigators examine event-planning documents, presentation materials, the speaker-selection process, prior communications, complete video footage, Lee’s statements and responses during the events, and the process through which footage was uploaded to her official YouTube channel, they may be able to establish more precisely what Lee knew and what actions she took as the organizer, independently of whether she personally made the disputed statement.
The complaints remain allegations at this stage. Neither the alleged violations of the May 18 Special Act by Lee and the other individuals nor the alleged defamation by Park Jie-won has been legally established. Any criminal liability will ultimately be determined through investigation and judicial proceedings.
